Understanding MSHA's Inspection Framework
30 CFR Part 56 covers metal and nonmetal surface mines. (Coal surface mines fall under 30 CFR Part 77.) MSHA inspectors conduct a systematic walk-through of all active work areas, covering machinery and equipment, electrical systems, haulage roads, explosives storage and use, fire prevention, and emergency procedures.
MSHA rates violations using two key assessments that directly affect penalty amounts:
- Significant and Substantial (S&S): A violation is S&S if there is a reasonable likelihood that the hazard will result in a reasonably serious injury. S&S designations carry higher penalties and accumulate in MSHA's enforcement database, which affects subsequent inspections and penalties.

- §56.14100 — Safety defects: Defects that affect safety must be corrected before the equipment is returned to service. If a defect cannot be corrected immediately, the equipment must be tagged out of service and physically prevented from being operated until repaired.
- §56.14101 — Pre-shift inspections: Equipment must be inspected before each shift. When defects affecting safety are found, they must be recorded. MSHA inspectors will ask to see inspection records — missing records for a recent shift is treated as evidence the inspection was not performed.
- §56.14112 — Seat belts: Every self-propelled mobile piece of equipment used at surface mines must have a functional seat belt installed. Operators must wear seat belts while the equipment is in motion. A broken, missing, or bypassed seat belt is an immediate S&S citation.
- §56.14130 — Rollover protective structures (ROPS): Dozers, scrapers, graders, wheel loaders, and other equipment subject to rollover must have ROPS meeting applicable SAE or equivalent standards.
- §56.14131 — Falling object protective structures (FOPS): Equipment operating beneath overhead hazards, including loaders working near highwalls or unstable banks, must have FOPS protecting the operator cab.
- §56.14132 — Overhead protection for haulage trucks: Haulage trucks that carry rock, ore, or other material must have canopy protection that meets MSHA's specifications for structural integrity.
Electrical Safety (§56.12001–56.12070)
- §56.12004 — Grounding: All electrical equipment frames and enclosures must be properly grounded. Ground continuity must be maintained in trailing cables — a broken ground wire in a trailing cable energizes the cable jacket and creates an electrocution hazard.
- §56.12006 — Disconnects: Disconnecting devices (circuit breakers, disconnects, switches) must be accessible, clearly identified as to what circuit they control, and in proper working order. Locked-out or inaccessible disconnects are citation targets.
- §56.12028 — Trailing cables: Cables dragging on roadways, running through water accumulations, or subjected to mechanical damage from equipment are frequently cited. Cables must be routed, supported, and protected against the specific hazards present at the work area.
- §56.12045 — Examination of electrical equipment: Surface electrical installations must be examined at intervals not exceeding one week by a qualified person. Examination records must be kept. MSHA treats missing examination records as evidence of a failure to examine.
- §56.12062 — Lockout/tagout: Before any electrical maintenance, the power source must be locked out and tested for absence of voltage. MSHA routinely cites facilities where workers are performing maintenance with power still on — sometimes because the lockout procedure requires traveling to a distant disconnect.
Haulage Roads and Berms (§56.9300–§56.9350)
- §56.9300 — Road construction and maintenance: Roads must be constructed and maintained to minimize dust generation, provide adequate traction in wet or muddy conditions, and be wide enough for the largest vehicle using them (including passing clearance).
- §56.9301 — Berms and guardrails: Berms or guardrails must be provided at the edge of all elevated roadways, around excavations, and at the crest of highwalls. The berm height must be at least mid-axle height of the largest vehicle using the road. Inspectors measure berm heights with tape measures — a berm that looks adequate may fail a measurement.
- §56.9306 — Traffic control: Where haul roads intersect, where equipment crosses pedestrian areas, or where blind intersections exist, traffic control measures (signs, spotters, one-way traffic) must be in place.
- §56.9310 — Dumping at dumps and fill points: Berms, bumper blocks, or other positive stops must prevent equipment from going over the edge at dump points. This is one of the most frequently cited regulations at surface mines — and the failure mode most associated with fatalities. A berm that a haul truck can push through is not an adequate berm under this standard.
Drilling and Blasting (§56.6300–56.6907)
- §56.6300 — Storage of explosives: Explosives must be stored in BATFE-approved magazines that meet ATF and MSHA requirements. Magazines must be locked when not attended. Incompatible explosives (boosters, detonators, high explosives) must be stored in separate magazines.
- §56.6600 — Blasting procedures: A written blast plan must exist and must be followed. All persons and equipment must be evacuated from the blast area before detonation. Warning signals must be given and acknowledged before blasting proceeds.
- §56.6605 — Warning signals: Recognized audible warning signals (sirens, horns) must be sounded before blasting. Workers must acknowledge receipt of the signal before blasting is authorized. A one-way communication system where only the blaster knows the blast is happening is not compliant.
- §56.6803 — Misfires: Misfired shots must be handled per specific procedures. Under no circumstances should a worker approach a misfired shot until at least 30 minutes have elapsed (or per the blaster's judgment based on the initiating system used), the area has been examined, and all charges verified as failed to detonate.
Workplace Examination Requirements (§56.18002)
This is a fundamental MSHA requirement that applies to every shift at every active surface mine:
- A competent person must examine each work area at least once per shift before miners begin working there
- If the examination reveals conditions that could endanger miners, those conditions must be recorded and corrected before work begins (or miners must be kept out of the area)
- Examination records must be retained for at least one year and must be made available to MSHA inspectors on request
